行政长官根据澳门特别行政区第3/1999号法律第六条第一款及第五条(二)项的规定,命令公布《中华人民共和国澳门特别行政区政府与保加利亚共和国政府互免签证协议》。

中华人民共和国澳门特别行政区政府与保加利亚共和国政府互免签证协议

获得中华人民共和国中央人民政府正式授权签订本协议的中华人民共和国澳门特别行政区政府和保加利亚共和国政府 (以下简称“缔约双方”),为了方便旅游并藉此促进双方的友好关系的发展,达成以下协议:

第一条

(一)持有本协议附件所列有效旅行证件的持有人,可免办签证进入或过境缔约另一方境内,由首次入境当天起计六个月内逗留不超过九十日。

(二)本条第一款所指的人应从向国际旅客开放的通行口岸进入及离开缔约另一方。

第二条

第一条所指的人倘入境缔约另一方逗留多于九十日,或为受雇或教育的目的,须事先取得该缔约方有权限当局的签证。

第三条

本协议不免除第一条所指的人应遵守在缔约另一方生效的法律和法规的义务。

第四条

对于第一条中所指的人,基于公众安全、公众卫生或公众秩序的理由,或倘其被认为不受欢迎,缔约任一方保留拒绝其进入或终止其在境内逗留的权利。

第五条

(一)为达到本协议的目的,缔约双方应在本协议签署后并在生效日前最少三十日交换附件所列的有效证件的样本。

(二)倘更新有效旅行证件的式样或启用新的旅行证件,缔约双方应在其启用之前最少三十日交换这些证件的样本及其使用上的必要资料。

第六条

第一条所指的人的旅行证件在缔约另一方境内遗失、被窃或损毁,应尽快向当地的有权限当局报案及应获发出确认此事实的文件。

第七条

如在适用本协议的过程中发生争论或分歧,缔约双方应以协商及征询的方式将其解决。

第八条

任何经缔约双方同意的对本协议的修改,应透过书面通知方式为之。

第九条

(一)基于公众安全、公众秩序或公众卫生理由,缔约任一方可以书面通知缔约另一方,临时中止本协议全部或部份条款。中止应实时生效并一直生效至另行通知为止。

(二)缔约任一方在采用本条第一款的措施后,应正式通知缔约另一方予以解除。

第十条

(一)本协议不设限期并于收到最后由缔约双方均已互相通知完成所有内部法律程序的通知之日起三十日后生效。

(二)缔约任一方可书面通知缔约另一方终止本协议。在此情况下,协议将在收到该通知之日起三十日后失效。

本协议于二○○五年四月八日在澳门特别行政区签订,一式两份, 每份分别用中文、保加利亚文和英文写成,三种文本同等作准。如在解释上遇有分歧,以英文文本为准。

附件

为本协议的目的,有效旅行证件包括:

(一)中华人民共和国澳门特别行政区方面:

a) 中华人民共和国澳门特别行政区护照。

(二)保加利亚共和国方面:

a)普通护照;

b)外交护照;

c)公务护照;

d)海员护照。

AGREEMENT BETWEEN THE GOVERNMENT OF THE MACAO SPECIAL ADMINISTRATIVE REGION OF

THE PEOPLE"S REPUBLIC OF CHINA

AND

THE GOVERNMENT OF THE REPUBLIC OF BULGARIA

ON THE ABOLITION OF VISA REQUIREMENTS

The Government of the Macao Special Administrative Region of the People"s Republic of China, which has been duly authorized to conclude this Agreement by the Central People"s Government of the People"s Republic of China, and the Government of the Republic of Bulgaria, hereinafter referred to as the ?Contracting Parties?,

desiring to facilitate travels and thus to promote the development of friendly relations between them,

have agreed as follows:

Article 1

1. Holders of valid travel documents, specified in the Annex to this Agreement, shall be exempted from visa requirements for entry into or transit through the territory of the other Contracting Party for up to 90 (ninety) days within a period of six months as from the date of their first entry.

2. Persons referred to in paragraph 1 of this Article, shall enter and leave the territory of the other Contracting Party through the border crossing points open to international passenger traffic.

Article 2

Persons referred to in Article 1 who enter into the territory of the other Contracting Party for a period exceeding 90 (ninety) days or to take up employment, or for educational purposes should obtain a visa in advance from the competent authorities of the respective Contracting Party.

Article 3

This Agreement does not exempt the persons mentioned in Article 1 from the obligation to abide the laws and regulations in force in the territory of the other Contracting Party.

Article 4

Either Contracting Party reserves the right to refuse the entry or to terminate the term of stay on its territory of persons mentioned in Article 1 for reasons of public security, public health or public order or in case they are considered undesirable.

Article 5

1. The Contracting Parties, upon the signing of this Agreement but not later than 30 (thirty) days prior to its entry into force, shall exchange specimens of the valid documents for the purposes of this Agreement as listed in the Annex hereto.

2. In case of any modification of the valid travel documents or introduction of new ones, the Contracting Parties shall exchange specimens thereof along with all the necessary information bearing upon the use of these documents not later than 30 (thirty) days prior to the date of their introduction.

Article 6

Persons mentioned in Article 1 whose travel documents have been lost, stolen or d"am"aged on the territory of the other Contracting Party shall be required to promptly inform the local competent authorities, which shall issue a document confirming this fact.

Article 7

If disputes or disagreements arise in the course of application of this Agreement, the Contracting Parties shall settle them by negotiations and consultations.

Article 8

Any "am"endment of this Agreement agreed upon by the Contracting Parties shall be effected by exchange of letters.

Article 9

1. Either Contracting Party may temporarily suspend, in whole or in part, this Agreement on the grounds of protection of public security, public order or public health, by notifying the other Contracting Party in writing. The suspension shall become effective immediately and shall remain in force until further notice.

2. The Contracting Party, which has introduced the measures under Paragraph 1 of this Article, shall duly notify the other Contracting Party of their revocation.

Article 10

1. This Agreement is concluded for an indefinite period of time and shall enter into force 30 (thirty) days after the receipt of the notice in writing by which the Contracting Parties have informed each other of the completion of all internal legal procedures required for its entry into force.

2. Either Contracting Party may terminate the validity of this Agreement by notifying in writing the other Contracting Party to that effect. In this case the Agreement shall become ineffective 30 (thirty) days after the date of receipt of such a notification.

Done at Macao SAR on 8 April 2005 in two originals, each of them in Chinese, Bulgarian and English languages, all text being equally authentic. In case of any divergence of interpretation, the English text shall prevail.

ANNEX

Valid travel documents for the purposes of this Agreement shall be as follows:

1. For the Macao Special Administrative Region of the People"s Republic of China:

a) passport of the Macao Special Administrative Region of the People"s Republic of China.

2. For the Republic of Bulgaria:

a) ordinary passport;

b) diplomatic passport;

c) service passport;

d) se"am"an"s passport.
