中华人民共和国政府和西班牙王国政府关于西班牙在中华人民共和国香港特别行政区保留总领事馆的协定

中华人民共和国政府和西班牙王国政府（以下简称“双方”），本着发展两国之间友好关系和加强两国之间领事关系的共同愿望，达成协议如下：

一、中华人民共和国政府同意西班牙王国政府在中华人民共和国香港保留总领事馆，领区为香港特别行政区。

二、中华人民共和国政府同意西班牙驻香港总领事馆自一九九九年十二月二十日中华人民共和国恢复对澳门行使主权之日起在澳门特别行政区执行领事职务。

三、中华人民共和国政府根据一九六三年四月二十四日《维也纳领事关系公约》及中华人民共和国有关的法律和规定，为西班牙驻香港总领事馆执行领事职务提供必要的协助和便利。

四、双方将本着协商合作的精神，根据国际法和国际惯例，友好地处理两国间的领事问题。

五、本协定自一九九七年七月一日起生效。双方在此日期前完成本协定生效必须的国内法律和宪法程序，并通知另一方。

下列签署人经各自政府授权，签署本协定，以昭信守。

本协定于一九九七年六月十八日在马德里签订，一式两份，每份都用中文、西班牙文和英文写成，三种文本同等作准。遇有分歧，以英文文本为准。

AGREEMENT BETWEEN THE GOVERNMENT OF THE PEOPLE"S REPUBLIC OF CHINAAND THE GOVERNMENT OF THE KINGDOM OF SPAIN CONCERNING THE MAINTENANCE BYTHE KINGDOM OF SPAIN OF THE CONSULATE-GENERAL IN THE HONG KONG SPECIALADMINISTRATIVE REGION OF THE PEOPLE"S REPUBLIC OF CHINA[1

The Government of the People"s Republic of China and the Government ofthe Kingdom of Spain (hereinafter referred to as "the two Parties"), outof a common desire to develop friendly relations and enhance consularrelations between the two countries, have reached the followingAgreement:

1. The Government of the People"s Republic of China agrees to themaintenance by the Government of the Kingdom of Spain of itsConsulate-General in Hong Kong of the People"s Republic of China, theconsular district of which shall be the Hong Kong Special AdministrativeRegion.

2. The Government of the People"s Republic of China agrees to theperformance by the Consulate-General of the Kingdom of Spain in Hong Kongof its consular functions in the Macao Special Administrative Region afterthe Government of the People"s Republic of China resumes the exercise ofsovereignty over Macao with effect from 20 December 1999.

3. The Government of the People"s Republic of China shall, inaccordance with the Vienna Convention on Consular Relations of 24 April1963 and relevant laws and regulations of the People"s Republic of China,accord necessary assistance and facilities to the Consulate-General of theKingdom of Spain in Hong Kong in the exercise of consular functions.

4. The two Parties shall handle consular matters between them in afriendly manner in the spirit of consultation and cooperation, and inaccordance with international law and practice.

5. The present Agreement shall enter into force on 1 July 1997. Thetwo Parties shall complete their respective domestic legal andconstitutional processes that are necessary to give effect to thisAgreement before this date and notify the other Party accordingly.

In witness whereof the undersigned, being duly authorized by theirrespective Governments, have signed this Agreement.

Done in Madrid, on June 18th 1997, in duplicate in the Chinese,Spanish and English languages, all texts being equally authentic. In caseof divergence, the English version shall prevail.
