为促进上海国际航运中心建设,推进海事执法信用监管制度,进一步提高外国籍船舶及其公司不断加强船舶安全管理的自觉性,营造上海“安全、便利、高效”的口岸营运环境,根据《中华人民共和国海上交通安全法》、《中华人民共和国海洋环境保护法》、《中华人民共和国对外国籍船舶管理规则》、《中华人民共和国船舶安全检查规则》等法律法规规定,制定了《“上海绿色船舶”评选办法》,现印发给你们,请遵照执行。

“上海绿色船舶”评选办法

第一章 总则

第一条 宗旨

为促进上海国际航运中心建设,推进海事执法信用监管制度,进一步提高外国籍船舶及其公司不断加强船舶安全管理的自觉性,营造上海“安全、便利、高效”的口岸营运环境,根据《中华人民共和国海上交通安全法》、《中华人民共和国海洋环境保护法》、《中华人民共和国对外国籍船舶管理规则》、《中华人民共和国船舶安全检查规则》等法律法规规定,制定本办法。

第二条 适用对象

本办法适用于在中华人民共和国上海海事局(以下简称上海海事局)辖区内航行、停泊和作业的外国籍船舶及其所有人、经营人(以下简称公司)。

第三条 原则

“上海绿色船舶”(以下简称“绿色船舶”)是经上海海事局评定认可的“安全、环保、优质”的船舶,此类船舶在上海水域可享受本办法所规定的相应优惠待遇。

符合本办法规定条件的船舶可自愿参加“绿色船舶”的评选。评选结果在上海海事局辖区范围内有效。

第四条 主管机关

中华人民共和国上海海事局是实施本办法的主管机关。

第二章 申请与审批

第五条 申请与受理

“绿色船舶”由船舶及其公司或其代理人向上海海事局政务中心(四平路190号,海事大厦1楼)提交申请。

第六条 申请条件

申请“绿色船舶”的船舶应同时满足以下条件:

(一)其船旗未被列为各备忘录组织的“黑名单”船旗国;

(二)其检验机构应为IACS(国际船级社协会)组织正式成员;

(三)最近36个月内在各备忘录地区港口国监督检查中未发生被禁止离港、禁止进港、驱逐出港等现象;

(四)最近12个月内接受过上海海事局的港口国监督检查,缺陷项目较少,且无严重缺陷;

(五)最近24个月内接受港口国监督检查中发现的平均缺陷数不多于5项,并且无严重缺陷;

(六)最近36个月内没有发生安全、污染责任事故;

(七)最近36个月内没有因违反海事法规的行为被给予行政处罚;

(八)最近12个月内来上海港频率应不少于4次;

(九)东京备忘录APCIS系统目标因素分值应为40分以下。

第七条 提交材料

申请“绿色船舶”评选应提交以下材料:

(一)按照附件1的要求填写《“绿色船舶”申请表》;

(二)公司所属船舶名单及其概况;

(三)最近24个月内接受港口国监督检查材料的复印件;

(四)船舶国籍证书、最低安全配员证书、DOC、SMC及其它船舶法定检验证书的复印件。

第八条 审批程序

(一)上海海事局受理申请后发现申请船舶六个月内未进行港口国监督检查的,将安排实施一次全面的港口国监督检查;该船已接受过检查的,上海海事局认为有必要可组织专业力量进行实船评估。

(二)上海海事局对申请材料进行审核与评估,综合考虑船舶及其公司的安全管理水平等因素,审批确定是否将申请船舶评选为“绿色船舶”。

第三章 证书管理

第九条 优惠待遇

“绿色船舶”享受以下优惠待遇:

(一)由上海海事局颁发有效期不超过24个月的“绿色船舶”证书,定期在有关网站上公布, 并向相关保险公司、租船人等社会机构、组织公开“绿色船舶”名单;

(二)对有效期内的“绿色船舶”免予港口国监督检查;

(三)优先办理办理船舶进出口岸手续;

(四)向上海海事局申请作业项目及航行服务等手续时给予便利;

(五)享受上海海事局制定的其它便利措施。

第十条 重新申请

重新申请“绿色船舶”的,应在原证书有效期截止之日前提出,可不受本办法第六条第(四)项关于12个月内接受过上海海事局港口国监督检查要求的限制。

第十一条 撤销机制

“绿色船舶”在有效期内有以下情形之一的,上海海事局将组织人员进行核查,并视情况撤销其“绿色船舶”的称号,并收回其证书:

(一)船舶及公司在申请“绿色船舶”中存在弄虚作假的现象;

(二)发生故意逃避、阻挠海事执法的行为;

(三)因存在严重缺陷或违反有关规定而被禁止离港;

(四)发生一般及以上等级的安全、污染责任事故;

(五)发生违反有关海事法规而被处罚的行为;

(六)其船旗国被各备忘录组织列入“黑名单”国家;

(七)被列入上海海事局“重点关注船舶”;

(八)上海海事局认为有必要撤销其“绿色船舶”称号的其它情形。

各相关单位发现“绿色船舶”有以上情形的应及时报告,上海海事局经核实后撤消其“绿色船舶”称号。

被撤销“绿色船舶”称号的,上海海事局在24个月内不再受理其“绿色船舶”评选的申请。

第十二条 证书失效

“绿色船舶”在有效期内有以下情形之一的,其“绿色船舶”证书自动失效:

(一)转入非IACS成员的船级社作为其检验机构;

(二)船舶变更船名、国籍及所有人或经营人。

第十三条 公司责任

被授予“绿色船舶”称号的,上海海事局不免除其公司、公司管理人员以及船舶、船员遵守国际、国内有关安全和环境保护法规的责任。

“绿色船舶”及其公司应严格遵守本办法规定,当发生第十一条第一款、第十二条所列之情形时,应主动向上海海事局报告。

第四章 附则

第十四条 定义

本办法中所称“严重缺陷”系指船舶在港口国监督检查中发现的严重影响船舶、人命财产安全或对水域有重大污染隐患的缺陷。

本办法中所称之“重点关注船舶”系指在上海海事局管辖范围内,行政相对人为逃避或妨碍海事公务执法而采用贿赂或其他类似非法行为,从中可能获得不正当利益的船舶。

第十五条 权利保留

上海海事局保留对有效期内的“绿色船舶”实施必要的港口国监督检查的权利。

第十六条 办结期限

上海海事局受理“绿色船舶”申请后,在20个工作日内作出是否授予“绿色船舶”称号的决定。

第十七条 解释权

本办法由上海海事局负责解释。

第十八条 生效

本办法自发布之日起生效。

“SHANGHAI GREEN SHIP” SCHEME

Part I

General

Article 1. Purpose

With the aim at accelerating the establishment of Shanghai International Shipping Centre, promoting the maritime credit supervision system; enhancing the consciousness of foreign ships and their companies in safety management and building Shanghai into a port of that is “safe; convenient, and effective”, Shanghai Maritime Safety Administration of the People"s Republic of China (hereinafter referred to as “Shanghai MSA”) enacts the “Shanghai Green Ship” (hereinafter referred to as “Green Ship”) Scheme in accordance with the Maritime Traffic Safety Law of the People"s Republic of China, Marine Environment Protection Law of the People"s Republic of China, Rules of the People"s Republic of China Governing Ships of Foreign Nationality,Ship Inspection Regulation of the People"s Republic of China and relevant provisions.

Article 2. Applicant

The Scheme shall apply to ships of foreign nationalities that sail, berth, and work within the jurisdiction of Shanghai MSA as well as their owners or managers (hereinafter referred to as “company”)。

Article 3. Principle

A “Green Ship” is the ship assessed by Shanghai MSA as being “safe, environment -friendly and of high quality”。 Such ships will enjoy privilege in Shanghai waters as hereinafter described in the Scheme.

Any ship in compliance with requirements of the Scheme can apply for the “Green Ship” at its own accord. Acceptance of such applications is within the jurisdiction of Shanghai MSA.

Article 4. Competent Authority

Shanghai MSA is the competent authority responsible for implementing the Scheme.

Part II

Application and Approval

Article 5. Where to apply

Applications for approval as a “Green Ship” should be made by Ship Captains and/or their companies or agents to the reception division of Shanghai MSA on the ground floor of the Shanghai Maritime Center at 190 Siping Road.

Article 6. Requirements for Application

A ship applying for a “Green Ship” shall meet with the all requirements as follows:

i) Its registered nationality shall not be a flag ranked on the “black list” by any Memorandum of Understanding (hereinafter referred to as “MOU”);

ii) Its Recognized Organization (hereinafter referred to as “RO”) shall be a member of IACS (International Association of Classification Societies);

iii) It has never been detained, denied entry or expelled from any port during PSC inspection in any MOU area within the last 24-month period;

iv) It has been inspected in Shanghai Port during last 12 months, and few deficiencies were found, none of which were serious;

v) The average number of deficiencies found in PSC inspection during the last 24 months is not more than 5, and none were serious;

vi) It has not been involved during the last 24 months in a liable accident related to marine safety or pollution;

vii) No penalty for behavior against maritime laws and regulations have been incurred during the last 24 months;

viii) Not less than 4 entries to Shanghai Port were made during the last 12 months; and

ix) The Target Factor in the APCIS info-system of TOKYO-MOU is less than 40.

Article 7. Application Materials

To apply for a “Green Ship”, the following material shall be submitted to Shanghai MSA:

i) An application form for the “Green Ship” filled out as required (details in Annex 1);

ii) The list of company"s ships and particulars;

iii) Copies of PSC reports issued within the last 24-month period; and

iv) Copies of ship"s Registry Certificate, Minimum Safe Manning Document, DOC & SMC and other relevant ship certificates of statutory survey.

Article 8. Approval Procedure

i) On receipt of an application, Shanghai MSA will arrange a PSC inspection on the ship concerned if it has not been inspected within the previous 6 months; if the ship has had a PSC inspection within the last 6 months, Shanghai MSA may, when considered necessarily, conduct a professional evaluation on the Ship.

ii) Shanghai MSA will verify and evaluate the materials submitted, then decide whether the ship is qualified to be a “Green Ship”。

Part III

“Green Ship” Management

Article 9. Preferential Policy

i) On satisfactory completion of the Approval Procedure a “Green Ship” certificate with a 24-month period of validity will be awarded by Shanghai MSA. The Certificate enables a “Green Ship” to enjoy the preferential policies set out in clauses ii) to v) below. A “Green Ship” list will be promulgated on related websites and be open to insurance companies, ship charterers, or other relevant organizations;

ii) Exemption of PSC inspection;

iii) Priority on formalities for endorsement control on its entering or leaving port;

iv) Convenience when the ship applies for operations, sailing services, etc.; and

v) Other privileges provided by Shanghai MSA.

Article 10. Re-application

A ship shall reapply for “Green Ship”status before the expiry date of its current certificate, and the ship is not restricted by the requirement of PSC inspection in Shanghai within 12 months as prescribed in article 6 iv) of the Scheme.

Article 11. Repeal

If a “Green Ship” is in any of the following conditions, Shanghai MSA will carry out on investigation to verify the situation, and can repeal the certificate:

i) False material provided by the ship"s Captain or company during the application for a “Green Ship”;

ii) Intentional evasive behavior or phenomenon against maritime law enforcement ;

iii) Being detained because of serious deficiency or violations against maritime laws;

iv) Being involved in an liable marine safety or pollution accident which has been identified as of general grade or upward;

v) Being penalized for marine violation;

vi) Having its flag ranked on the “black list” of any MOU;

vii) Being ranked on the “Special list” by Shanghai MSA; or

viii) Other conditions regarded as necessary to repeal its “Green Ship” Certificate by Shanghai MSA.

Any agency or organization shall report a “Green Ship” to Shanghai MSA if they are aware that any of the above mentioned conditions apply to it. After it has been confirmed by Shanghai MSA that a violation of one or more of the conditions above has occurred, the “Green Ship” Certificate will be repealed

Shanghai MSA will not accept any application made on behalf of a repealed ship for a “Green Ship” Certificate within the period of 24-months.

Article 12. Certificate Invalidation

The “Green Ship” certificate will be automatically invalid if the ship is in any of the following conditions:

i) Switch to a non-member of IACS as its RO; or

ii) Alteration of the ship"s name, nationality, owner, or manager.

Article 13. Company Obligation

Shanghai MSA does not exonerate a“Green Ship”ship, its company, company manager and seafarers from the obligation of subjecting to relevant laws, rules, and regulations as well as the relevant International Conventions.

The “Green Ship” and its company shall be in line with the Scheme. When any conditions as prescribed in paragraph i) to viii) of article 11 and article 12 happens, the ship"s Captain and ship"s company shall voluntarily report it to Shanghai MSA.

Part IV

Supplementary Articles

Article 14. Definitions

The term “serious deficiency” means any deficiency, found during PSC inspection, which seriously threatens the safety of ship, human life and property, or pollution of the marine environment.

The term “Special List” means the list on which the ships are those whose company or any personnel concerned offers bribes to functionaries of Shanghai MSA with an aim to evade or impede maritime law enforcement.

Article 15. Reserved Right

Shanghai MSA reserves the right to conduct a PSC inspection on any “Green Ship” ship, if considered necessary.

Article 16. Completion Term

Shanghai MSA shall decide whether a ship is qualified to be a “Green Ship” within 20 working days from the date of application was accepted.

Article 17 Interpretation Right

The right of interpretation of the Scheme rests upon the Shanghai MSA.

Article 18 Entry into Force

The Scheme shall enter into force on the date of promulgation.
